School bans breast cancer awareness bracelets, litigates in court and loses nearly $500,000
There is something about school administrators. An abnormally large number of them have no concept of and indeed show a great hostility to the First Amendment protection of freedom of speech.
Between FIRE, the ACLU, the ADF and other civil rights organizations, the complaints and legal victories over public schools and universities who flagrantly and illegally work to crush freedom of speech are so frequent that civil rights are swamped with cases. School administrators, out of spite, drag out and appeal many cases they know are hopeless as you, the taxpayers, pay the bill.
The laws need to be changed so that the worst examples of school administrators gone wild are held personally liable for their illegal actions.

EASTON, Pa. – Easton County taxpayers are now on the hook for a $385,000 settlement after a four-year legal battle over the school district’s attempt to ban “I Heart Boobies” cancer awareness bracelets.
Brianna Hawk and Kayla Martinez sued the Easton Area School District with the help of the American Civil Liberties Union after school officials in October 2010 disciplined the former middle school students for wearing the popular wristbands, the Allentown Morning Call reports.
The girls argued the district’s policy violated their First Amendment rights, and the U.S. District Court and 3rd Court of Appeals agreed, ruling that the bracelets are protected speech because they are a social or political statement. Despite the legal losses, district officials attempted to appeal the case to the U.S. Supreme Court, but were forced to acknowledge defeat after the high court refused to hear the case in March, according to the news site.

The grand total comes to $385,000 paid in three installments over the next nine months, which is on top of the $110,000 the district has already spent defending the case, though the school district’s insurance company covered most of that expense, according to the news site.

Carmen Segarra is a hero.

Former bank examiner Carmen Segarra vaulted into public consciousness earlier this month when she filed a wrongful termination lawsuit alleging that the Federal Reserve Bank of New York fired her after she refused to go soft on investment banking behemoth Goldman Sachs.
As ProPublica has reported, the Fed hired Segarra in late 2011 as part of a group of examiners brought on to monitor systemically important banks in the aftermath of the Dodd-Frank regulatory overhaul. The Fed wanted experts in key areas — such as operations, compliance and credit risk — to examine the “Too Big To Fail” financial institutions.

Segarra says she was fired after she found that Goldman lacked an adequate company-wide policy to manage conflicts of interest — and after her superiors urged her to change this finding and she refused. The Fed has denied any wrongdoing in the case, as has Goldman, which is not a defendant in Segarra’s lawsuit.

Police Arrest Woman for Possession of SpaghettiOs
…and she was in jail for a month. She should sue and sue big time. Why? As one commenter put it so ably:
Possession of a spoon is not probable cause! Over 300 million Americans own spoons. And I am certain a large percentage use spoons in their cars. Now a lighter, that is a different story. I am certain anyone who owns a lighter will use it for nefarious reasons. (Rolls eyes…) What ever happened to innocent until proven guilty?

A Georgia woman has been released after she was arrested for possession – of SpaghettiOs.
According to the Gainesville Times, police arrested Ashley Huff, 23, when they found a “suspicious residue” they believed to be meth on a spoon inside the car she was riding in.
Huff was subsequently charged with possession of methamphetamine.
Huff repeatedly told police that there was “no way in hell” that the substance was drug residue, according to Hall County assistant public defender Chris van Rossem.
Huff was unable to afford her bail and spent more than a month in jail while her attorney attempted to arrange a plea bargain.
She was released only after the crime lab finally came back with the results of its substance analysis.
It was spaghetti sauce.
“I think she said it had been SpaghettiOs,” said van Rossem.
Jordan Richardson, a visiting legal fellow at The Heritage Foundation, said police are generally within their rights to make an arrest when there is probable cause, but did raise concerns about the plea deal Huff was considering before the results came back from the crime lab. “The scary thing is that when she was confronted with jail and a fine, even though she turned out to be innocent, it was easier to take the punishment,” said Richardson.
According to KRON 4, Huff is considering legal action.
Obamacare costing taxpayers $10,000 per insured person
…And that is not including premiums and co-pays – YOU, each and every tax payer, are paying this bitter pill whether you bought Obamacare or not.

Health coverage was never so costly until President Obama decided to make it “affordable.”
Bloomberg News has tallied up the total cost to taxpayers of Obamacare so far: $73 billion and counting. What Bloomberg didn’t do is compare that cost to the government’s latest estimate of the number of people who have obtained Obamacare coverage: 7.3 million, and possibly falling.
That means taxpayers have shelled out $10,000 per insured person.
Only a relatively small portion of that $73 billion went for actual subsidies to help people afford coverage, according to Bloomberg. The large majority of the money was spent on health IT, exchange grants to get the state websites up and running, and contractor spending. Most of those outlays have been miserable failures.
Oh, and Bloomberg rightly included the $25 billion Democrats stuck in their nearly $800 billion February 2009 stimulus plan to push doctors and hospitals to adopt electronic health records (EHR). Virtually everyone involved concedes that effort is still a “work in progress.”
BUT, that $10,000 per insured person also excludes a number of things. That’s only what taxpayers have spent; it doesn’t include how much those newly insured people are coughing up out of their own pockets for their premiums, which can be thousands of dollars a year.
Nor does it include the money that left-leaning private sector groups funneled to the Obamacare rollout efforts. I don’t think anyone has a good estimate on how much was spent, but it was surely in the millions.
Nor does it include money that then-Secretary of Health and Human Services (HHS) Kathleen Sebelius tried to squeeze from health insurance CEOs to promote Obamacare. She apparently stopped the shakedown when news stories emerged about her practice and how unethical, not to mention illegal, it was for a federal regulator to ask for donations from the very companies she’s regulating.

1 in 4 Americans Aged 25-54 Not Working
And yet immigration both unskilled and skilled is at record levels.
A new chart from the minority side of the Senate Budget Committee shows a startling fact: Almost 1 in 4 Americans between the ages of 25-54 (or prime working years) are not working.
Here’s a chart showing those in that age group currently employed (95.6 million) and those who aren’t (28.9 million):
“There are 124.5 million Americans in their prime working years (ages 25–54). Nearly one-quarter of this group—28.9 million people, or 23.2 percent of the total—is not currently employed. They either became so discouraged that they left the labor force entirely, or they are in the labor force but unemployed. This group of non-employed individuals is more than 3.5 million larger than before the recession began in 2007,” writes the Republican side of the Senate Budget Committee.
“Those attempting to minimize the startling figures about America’s vanishing workforce—workplace participation overall is near a four-decade low—will say an aging population is to blame. But in fact, while the workforce overall has shrunk nearly 10 million since 2009, the cohort of workers in the labor force ages 55 to 64 has actually increased over that same period, with many delaying retirement due to poor economic conditions.
“In fact, over two-thirds of all labor force dropouts since that time have been under the age of 55. These statistics illustrate that the problems in the American economy are deep, profound, and pervasive, afflicting the sector of the labor force that should be among the most productive.”

Schools welcome Revolutionary Communist Party (RCP) into classrooms. Of course, those who follow public education issues understand that some union leaders and school administrators are members of, or are very sympathetic to the RCP.

NEW YORK – Several schools are giving radical anti-war organizations access to their classrooms.
One such organization is The World Can’t Wait, an anti-war organization started by Charles Clark Kissinger, a former Students for a Democratic Society member and longtime leader of the Revolutionary Communist Party.
According to The World Can’t Wait’s website, as part of its WANYS program, IVAW members visited several schools across the country during the 2012-2013 school year, often showing students the video, Collateral Murder, and then engaging them in conversations about it.
Collateral Murder is a video of two U.S. Apache helicopters firing on a group of men in Baghdad in 2007. The video was obtained, given the name Collateral Murder, and released in 2010 by Julian Assange of WikiLeaks.
The problem with the video is that, shortly after it was released, it was proven to have been edited. Yet two to three years later, the video is being shown to students by The World Can’t Wait and IVAW?
As evidenced from this video of U.S. military veteran Ethan McCord narrating Collateral Murder, it appears that even the most bloody and graphic images taken from the strike are being shown to students. In the first minute of the video, McCord says that U.S. soldiers are trained from day one to dehumanize the enemy and also “to dehumanize civilians here at home”. Later in the video, he says he encourages students to push military recruiters out when they visit schools, and then goes on to refer to military recruiters as pimps and the army as their whore.
Collateral Murder was edited to make it look like U.S. military may have fired on civilians without cause. However, removed from at least one version of the video released by WikiLeaks were crucial minutes revealing discussions of hostile gunfire and the presence of at least one AK-47 and RPG in the hands of the insurgents.

The government actually argued that Yahoo should not even be allowed to challenge the seizure of your personal information and emails in court.

WASHINGTON (AP) — Yahoo said Thursday the government threatened to fine the company $250,000 a day if it did not comply with demands to go along with an expansion of U.S. surveillance by surrendering online information, a step the company regarded as unconstitutional.
The outlines of Yahoo’s secret and ultimately unsuccessful court fight against government surveillance emerged when a federal judge ordered the unsealing of some material about Yahoo’s court challenge.
In a statement, Yahoo said the government amended a law to demand user information from online services, prompting a challenge in 2007 during the George W. Bush administration.
“Our challenge, and a later appeal in the case, did not succeed,” Yahoo general counsel Ron Bell said in a statement.
The new material about the case underscores “how we had to fight every step of the way to challenge the U.S. government’s surveillance efforts,” Bell added. “At one point, the U.S. government threatened the imposition of $250,000 in fines per day if we refused to comply.”
Bell said the Foreign Intelligence Surveillance Court upheld the predecessor to Section 702 of the FISA Amendments Act. Section 702 refers to the program called PRISM, which gave the government access to online communications by users of Yahoo.
Former National Security Agency contractor Edward Snowden disclosed the program last year.
Yahoo said it is committed to protecting users’ data and that it will continue to contest requests and laws that it considers unlawful, unclear or overly broad.
“We consider this an important win for transparency, and hope that these records help promote informed discussion about the relationship between privacy, due process and intelligence gathering,” said Bell.
The newly released documents show that the Bush administration was taking a hard line and was miffed that Yahoo had even been allowed to get into court with its complaint.
In sum, the Foreign Intelligence Surveillance Court erred in permitting Yahoo to challenge the directives, said a court brief signed by then-U.S. Attorney General Michael Mukasey.
Yahoo was arguing that what the Bush administration was doing violated the Fourth Amendment rights of customers of Yahoo.

Three years after filing suit and a full eight years after I started to criticize universities, including my own, for violating the First Amendment I lost a bid to go to trial. I also lost all credibility as a free speech advocate. Or so I thought.
Don’t let anyone tell you that our university officials are ignorant of the First Amendment. They are not. In fact, they know all about it. But they are actively trying to destroy it with one convoluted argument at a time. The most extreme example I ever saw occurred in Richmond, Virginia on January 26, 2011.

You lose a measure of control over your life and you just have to trust your attorneys and follow their orders. 46% of doctors give Obamacare a ‘D’ or ‘F’

Forty-six percent of doctors give President Obama’s healthcare law a “D” or an “F,” according to a new survey from the Physicians Foundation. In contrast, just 25 percent of those surveyed gave the law an “A” or a “B.”
The findings come from a survey that was emailed to “virtually every physician in the United States with an email address on record with the American Medical Association” this March through June as the law’s major provisions were taking effect, and received more than 20,000 responses from doctors.
In their comments that were included (but kept anonymous) in the report, a number of doctors complained about the vast amount of bureaucracy that has been added to the medical profession.
“Get government OUT of healthcare,” one doctor wrote.
Another wrote, “Repeal Obamacare.”
Another comment read, “I’m a Canadian physician practicing in the United States. The politicians and policy makers need to understand that government involvement in healthcare never works.”
One argued that “health reform would be better served by removing many thousands of pages of laws and bureaucrats rather than adding many thousands of pages of laws and bureaucrats.”
Several doctors said they were planning to leave the profession, though it wasn’t clear that it was necessarily due to the law.
“The system is broken and I am out of here as soon as I can. I am tired of being used, abused and lied to. Has anyone here woken up to the fact that we are always the last ones to be considered in the equation of change?” one asked.
Head of Homeland Security: Granting amnesty will encourage terrorists to come forward…
This is one of the most towering examples of politically motivated Orwellian doublespeak we have ever witnessed…and that is saying a lot.
(CNSNews.com) – Homeland Security Secretary Jeh Johnson said at a House Homeland Security Committee hearing on Wednesday that granting amnesty to millions of illegal aliens in the United States could encourage terrorists among them to come out of the shadows.
“From my homeland security perspective, I want people who are living in this country undocumented to come forward, to get on the books, and subject themselves to a background check so that I can know who they are and whether it’s the current DACA (Deferred Action for Childhood Arrivals) program or a path to citizenship – whether it’s deferred action or earned path to citizenship. From my homeland security perspective, I want people to come forward,” Johnson said.

To which Rep. Lou Barletta (R-Pa.) replied with air of disbelief: “Do we honestly believe that any would-be terrorist or criminal or drug dealer is going to come forward to have a criminal background check done on them? They’re going to continue to remain underground.

Reporters: White House sometimes demands changes to press-pool reports
Those of us who have journalism degrees or understand how the White House Press Corps is supposed to work understand full well that even such a request, much less a demand, such as this is completely unacceptable.
If President Bush would have even requested anything like this the result would be wall to wall coverage of the Bush Administration’s war on free speech and transparency. The fact that the current Press Corps allows this to happen is testimony to just how partisan and corrupt the elite media has become.
White House press-pool reports are supposed to be the news media’s eyes and ears on the president, an independent chronicle of his public activities. They are written by reporters for other reporters, who incorporate them into news articles about President Obama almost every day.
Sometimes, however, the White House plays an unseen role in shaping the story.
Journalists who cover the White House say Obama’s press aides have demanded — and received — changes in press-pool reports before the reports have been disseminated to other journalists. They say the White House has used its unusual role as the distributor of the reports as leverage to steer coverage in a more favorable direction.
